Judge Tarnow Order: PBGC to Release Privileged Documents

IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF MICHIGAN SOUTHERN DIVISION

In Case No. 2:09-cv-13616, Dennis Black, et al., Plaintiffs, v. Pension Benefit Guaranty Corporation, Defendant, Judge Tarnow issued the following ruling on July 21, 2014:

ORDER OVERRULING DEFENDANT’S [PBGC] OBJECTIONS TO MAGISTRATE JUDGE’S ORDER OF AUGUST 21, 2013.

By this ruling Judge Tarnow orders the PBGC to release all documents to the Delphi Salaried Retirees.  This is another significant and positive ruling for Delphi Salaried Retirees who lost much of their pensions through the processes of the GM and Delphi bankruptcies in 2009.  The retirees' attorneys will immediately take action to obtain documents from the PBGC.

Significant Ruling by U.S. District Court, DC

U.S. District Court, District of Columbia
Today June 19, 2014, Judge Emmet G. Sullivan issued a significant ruling in favor of the plaintiffs, DSRA et al., effectively ordering the U.S. Treasury to produce all relevant information related to the Treasury's  involvement in the PBGC's assumption of the Delphi salaried pension plans in 2009.
The DSRA's attorneys will move forward immediately to obtain all related information from the Treasury.
