Some Delphi Salaried Retirees Will Receive Payments From Both PBGC and Prudential

The PBGC has published this undated information believed to have been released today:
Starting June 1, about 6,000 Delphi salaried retirees will see a change in how they receive their retirement benefit. They will continue to receive the same benefit amount.
If you are one of the affected retirees, PBGC sent you a letter on April 30. The letter explains that instead of a single monthly benefit payment, you will now receive two payments each month. ~~ Read full PBGC FAQ
DSRA is taking legal advice regarding the significance and impact of this change but has no further information to provide on this subject at this time. Meanwhile, all questions should be directed to the PBGC via their contact page.

WASHINGTON D.C. – Tue 2013-04-09, U.S. Senator Sherrod Brown (D-OH) announced that the Department of the Treasury has agreed to meet with the Delphi Salaried Retirees Association (DSRA). This announcement comes on the heels of Brown’s efforts to push the Obama Administration to meet with the Delphi salaried retirees and to pursue efforts that would restore the retirees’ pensions and benefits.
“I will continue to stand by the Delphi retirees as they make their important case to the Administration,” Brown said. “We all need to work together to find a solution that would restore the pensions and benefits that Delphi retirees deserve.” ~~

Congressman Chris Collins, NY-27, has joined the auto industry pension task force for the 113th Congress. Made up of members of the House of Representatives from both political parties, the group works to bring attention to the issues related to the termination of Delphi salaried retiree pensions.
"Delphi salaried retirees were stripped of the benefits they worked for and were promised," Collins said. "This task force will work in a bipartisan way to help advocate for these retirees and try to find a solution that restores the salaried pensions without impacting federal taxpayers."
Collins met with John Benoit and Rick Strusienski, both Delphi salaried retirees, to discuss the situation in Niagara County. The task force was founded last month and is chaired by congressmen Turner and Ryan, both of Ohio.

Washington — The long-running lawsuit by Delphi Corp. salaried retirees over the Pension Benefit Guaranty Corp.'s decision to assume the bankrupt auto supplier's pensions hasn't been cheap. ~ the PBGC says it has spent nearly $2 million to pay an outside contract law firm. As many as 50 lawyers have been going through 1.5 million pages of records that PBGC may have to turn over to lawyers for the retirees that are suing, consuming hundreds of hours of attorney time. ~ Lawyers for Delphi's pension recipients want a federal judge to force PBGC to turn over more documents in a more timely fashion. As DSRA uncovers more evidence proving that the government illegally terminated our pension plan even as the government continues its cover-up of the facts, key Members of Congress are maintaining their efforts that help our cause. Some cannot be revealed, but one visible way is new, bipartisan legislation to make the federal government more open to taxpayers.
HR 1211 was introduced on March 15 by Chair of the House Oversight and Government Reform Committee Darryl Issa (R-CA) and co-sponsored right away by the committee's Ranking Democrat Elijah Cummings (D-MD). The bill already has passed this key committee by voice vote on March 20 -- with an important amendment introduced by Rep. Michael Turner (R-OH) that gets at the heart of our issue. DSRA is very much appreciative of these efforts.

Today a bipartisan request was submitted supporting Delphi Salaried Retirees with a letter to Mr. Josh Gotbaum, Director, PBGC, asking for an update on timing and completion of benefit determinations for the pensions that were assumed by the PBGC in 2009. The PBGC has declined to provide this information since they assumed the Delphi salaried pensions over 3½ years ago.
Today's request was submitted by Congressmen Mike Turner, Tim Ryan, David Joyce, Steve Stivers, Jim Jordan, Brian Higgins, Bill Johnson, and Spencer Bachus.

A trio of events may prove critical in the ongoing fight between Delphi salaried retirees and the government over the retirees’ pensions.

This month, attorneys for the retirees will question officials of the Pension Benefit Guaranty Corp., or PBGC, during depositions under oath. The retirees sued the PBGC in federal court more than three years ago after the agency agreed to take on the retirees’ pensions from a then-bankrupt Delphi in July 2009.

A report from the Office of the Special Inspector General for the Troubled Asset Relief Program (also called SIGTARP) in its own probe into the matter is expected to be released soon.

In February, U.S. Reps. Mike Turner, R-Dayton, and Tim Ryan, D-Niles, announced the creation of a congressional task force to unify several committee and sub-committee investigations into the federal government’s treatment of pensions of more than 20,000 retired Delphi managers and engineers.
